Contract Requirements
Contract & Copy Terms
- A contract must be signed by all advertisers. Agency insertion orders are accepted, subject to provisions of Flying House Productions' current rate card and prevailing advertising specifications.
- Rates are subject to change without notice.
- All advertising is subject to approval of the Publisher.
- Cancellation or changes may not be made by the advertiser or its agency after space deadlines. Cancellation or changes made prior to closing must be submitted in writing. Flying House Productions reserves the right to either run the most recent advertisement when no acceptable copy is furnished or charge for the unused space.
- Advertisers and advertising agencies assume full responsibility and liability for all content of advertising printed and also assume liability for any claims arising therefrom.
- In the event of an error by Flying House Productions, the maximum liability is limited to the space charge for that issue on the contract. In that case, the space cost for that issue will be waived and the contract will be extended by one issue, so that the total contract price and discounts will remain unaffected.
- Flying House Productions shall not be liable for errors in proofs approved by advertisers.
- Flying House Productions shall not be liable for any costs or damages if for any reason Publisher fails to run an advertisement.
- Flying House Productions shall not be subject to any liability for failure to publish or circulate all or any part of an issue or issues due to cancellation of performances, strikes, work stoppages, accidents, fires, acts of God or any other circumstances not within the control of Flying House Productions.
- Positioning of advertisements is at the discretion of Flying House Productions unless a guaranteed position premium is paid.
- It is clearly understood and agreed that advertising and editorial are independent and that no special editorial consideration shall be part of the sales agreement.
- Advertising material will be held for one year and then discarded unless otherwise specified.
- Accredited advertising agencies providing ads per the prevailing advertising specifications are entitled to a 15% discount.
- Frequency discounts are available based on the current Flying House Productions rate card. Advertisers or agencies canceling orders in writing before the expiration of the contract will be billed a short rate if applicable at the frequency rate for each actual run insertion.
Credit:
Until credit has been established, payment in advance is required and is due before the space deadline for each scheduled issue.
Billing & Payment:
Once credit is established, payment is due upon receipt of invoice.
An interest charge of 1.5% per month will be added after the 28th day of the month designated on the invoice.
NSF charge: $50.
Visa, MasterCard and American Express credit or debit cards are accepted.
Past Due:
If an advertiser's open line of credit becomes delinquent (no payments within 60 days of invoicing), Flying House Productions has the right to demand payment in full. All sums owing are immediately due. If an account is not made current, all remaining scheduled advertising will be on a prepaid basis only, may be canceled or the account may be turned over for collection.
Collection:
Any account turned over for collection will be assessed a 20% collection charge based on the total amount due Flying House Productions for both space and finance charges. The advertiser and/or agency promises to pay all costs in the collection of overdue amounts whether or not litigation is commenced. If litigation is commenced, advertiser and/or agency promises to pay such additional sums as the court may judge to be reasonable as attorney's fees and court costs.
